Rep. Cutler and Rep. Heroux file bill to protect lawful gun owners

Rep. Paul Heroux and I have filed legislation to fix the state's firearms application process. Due to state licensing delays some law abiding gun owners can find themselves in technical violation of state gun laws through no fault of their own. Our legislation would extend the 90-day grace period for FID card renewals and extend license to carry renewals up to 180 days. We have 40 bi-partisan co-sponsors.Once released from the Rules Committee, the bill will be heard by the Committee on Public Safety and Homeland Security. Text of the bill is below.

In the Year Two Thousand Thirteen



An Act to preserve 2nd Amendment Rights.

            Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

            SECTION 1. Section 131 of chapter 140 of the General Laws, as appearing in the 2012 Official Edition, is hereby amended by inserting after the word “license”, in line 236, the following words:- “and all rights and privileges”.

            SECTION 2. Paragraph (e) of said section 131 of said chapter 140 of the General Laws, as so appearing, is hereby amended by inserting after the first paragraph the following paragraph:-

            On the day an application is submitted for renewal of a license, the licensing authority shall issue a receipt of notification that a renewal application has been submitted and is pending review. The receipt shall include the date the renewal application was submitted and the date of expiration for the application, which shall be 180 days from the submission of the renewal application. The receipt shall also recognize that all rights and privileges shall be preserved while the renewal application is pending review.

            SECTION 3. Said section 131 of said chapter 140, as so appearing, is hereby amended by striking out, in lines 236, 241, 269, 318 and 331 , the figure “90” and inserting in place thereof the following figure:- 180.
